The Data Act is an EU regulation that reshapes the rules for managing and sharing data in the digital environment. Its primary objective is to establish a harmonised, fair and transparent framework for data access and data sharing across the European Union.

To reduce legal and regulatory risks, organisations subject to the Data Act should ensure that their processes, documentation and technical solutions comply with its requirements. The regulation has applied since 12 September 2025.

The Data Act applies to a wide range of organisations operating in the digital economy – including those that use or provide services based on data generated by connected products or users.

The regulation applies to both large technology companies and smaller businesses that develop digital solutions or rely on data as part of their operations.

As a result, the Data Act has a direct impact on a significant share of the market – from innovative start-ups to global digital service providers.

What does this mean for your organisation?

The Data Act introduces several new obligations, including:

    • providing users with access to data generated by their connected products and enabling data portability,
    • establishing appropriate governance for both personal and non-personal data,
    • updating agreements with customers, suppliers and business partners, including providing mandatory information to users,
    • facilitating switching between cloud service providers,
    • implementing secure and transparent APIs for data access and sharing.

To reduce the risks associated with non-compliance, assess whether your organisation meets the requirements of the Data Act.

ćA Data Act compliance assessment helps identify what data your organisation collects and processes, who has access to it, which data must be made available to users or third parties, and what security measures should be implemented. The assessment also identifies gaps in your existing processes and policies, providing the foundation for a structured compliance roadmap.
