    AI Act (Artificial Intelligence Act) is an EU regulation governing the use and development of artificial intelligence.Its main goal is to enhance safety, transparency, and accountability in the application of AI across Europe.

     Implementing the AI Act requirements is a complex process, which is why companies should begin their compliance efforts as early as possible – to avoid the risk of penalties and operational restrictions.

    The AI Act applies to providers, importers, distributors, and users of artificial intelligence systems.

    The scope of obligations under the AI Act depends on the risk category assigned to a given AI system.
    The higher the risk, the more stringent the requirements an organization will need to meet.

    Requirements include, among others: risk management, system testing, proper data governance, technical documentation, self-assessment of compliance, and logging of AI activities.. All entities must ensure transparency including informing users about their interactions with AI systems.

    Who does the AI Act apply to?

    The AI Act has a broad scope and applies to companies operating both within the European Union and outside of it, if their AI systems are made available in Europe.

    • Providers of AI systems and general-purpose AI models – companies placing AI systems on the market or putting them into service, regardless of their location

    • Organizations using AI systems – businesses that use artificial intelligence in their operations

    • Providers and users of AI systems from outside the EU – entities whose AI systems are used within the EU

    • Importers and distributors of AI systems – organizations that trade and distribute AI solutions within the EU

    • Producers of products integrated with AI systems – companies introducing products containing AI under their own brand

    • Authorized representatives of non-EU providers – entities representing AI providers based outside the EU

    • Individuals and organizations affected by AI systems – users and entities in the EU impacted by AI-based decisions or actions

    Non-compliance with the AI Act may result in fines of up to:

    • €35 million or 7% of global annual turnover
      from the previous financial year — for engaging in prohibited AI practices
    • €15 million or 3% of global annual turnover
      for failure to meet other regulatory requirements
    • €7.5 million or 1% of global annual turnover
      for providing misleading or incorrect information to supervisory authorities
